The German version of these terms is the binding one, and this text is a translation of it. Where the two differ, the German version applies.
Short terms for a small app. They apply to the Hamoji app and to this website.
The service
Hamoji is an app for two people in a pair. You send each other hamsters — characters the app draws and brings to life — with a mood, an outfit and, if you like, a note, and what you send gathers in a calendar you share. Nobody but the two of you sees your pair.
Your account
You can try Hamoji without an account; sending, inviting and buying need one. You sign in with Apple or with a code sent to your email address — keep access to that address, because that is how the account is reached again.
An account belongs to one person, and a person has one pair at a time. You are responsible for what is done through your account.
What you send
You are responsible for what you send. Do not send anything unlawful, threatening, harassing or hateful, sexual content involving minors, spam, or anything that infringes the rights of others.
What you send becomes part of your partner’s calendar and stays there — also when the pair ends, and when you delete your account, then without your name and color. Think of a note as a letter: once delivered, it is theirs to keep. The privacy policy describes this in full.
The hamsters, their looks, moods and things belong to us. You may share the pictures the app makes of them for your own, non-commercial purposes.
Fair use
Do not try to break, overload or circumvent the service, to access another pair’s data, to guess invitation codes, or to use Hamoji to send spam. We may restrict an account that harms the service or other people.
Reports and contact
To report content that is unlawful or breaks these terms, abuse of the service, or anything else about Hamoji, write to support@hamoji.app. The same address is the single point of contact for authorities and for users under Articles 11 and 12 of the EU Digital Services Act, in German or English.
We look at every report. Content that breaks the law or these terms may be removed and the account that sent it restricted or closed; the person concerned is told why, unless the law forbids it.
Availability
Sending, receiving, sign-in and notifications need a network and may be interrupted for maintenance or by an outage of a provider. What you already have stays readable on your phone. No uptime is guaranteed.
Hamoji Plus and purchases
Hamoji is free to use. All moods, notes, the calendar and your memories stay free for good, with four of the hamsters and part of the wardrobe.
Hamoji Plus is a subscription for two: one of you pays, and both of you have it for as long as the pair lasts. It unlocks every hamster and every wardrobe item that the app marks as included in Hamoji Plus, new ones included. It is sold inside the app through Apple’s App Store, by the month or by the year. The yearly plan may start with a free trial; the screen says how long it is and what follows. The price is shown in your local currency before you buy and is charged to your Apple ID.
While the subscription of one of you renews, the other cannot buy another. When the one who pays turns renewal off, the other can take Hamoji Plus over without a gap.
When a pair ends, Hamoji Plus stays with the one who pays. A first hamster chosen with Hamoji Plus stays yours afterwards, but sending it again needs Hamoji Plus.
A subscription renews automatically unless it is canceled at least 24 hours before the end of the period. You cancel it in the subscription settings of your Apple ID at any time; the paid period then runs to its end. Deleting your account does not cancel a subscription.
If a renewal payment fails, Hamoji Plus keeps working for a grace period while the App Store tries again. If no attempt succeeds, the subscription ends.
A one-time purchase — a hamster, a set of items or a seasonal item — belongs to the person who bought it, for good: without Hamoji Plus and after the pair ends. Neither Hamoji Plus nor one-time purchases can be shared through Family Sharing.
Purchases are restored with the same Apple ID from within the app. Refunds are handled by Apple under Apple’s terms; your statutory rights remain unaffected.
Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For a slightly negligent breach of an essential contractual obligation — one whose fulfilment makes carrying out the contract possible in the first place and on which you may regularly rely — our liability is limited to the damage that is typical for the contract and foreseeable. Otherwise, liability for slight negligence is excluded. Your statutory rights in case of defects remain unaffected.
Ending it
You can stop using Hamoji at any time and delete your account from inside the app: Settings → Account → Delete account. What happens to what you sent is described in the privacy policy. We may end an account that is used in breach of these terms, with notice where that is possible.
Changes
These terms may change as the app does. The date at the top says when they last did, and a material change will be announced in the app.
Applicable law
These terms are governed by German law. Mandatory consumer protection rules of the country where you live remain unaffected. Hamoji is offered by Andrey Fedyukov, Mecumstraße 52, 40225 Düsseldorf, Germany; questions go to support@hamoji.app.
